Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the AIMeditateMe mobile application and website (the "Service") operated by Onurcan Icen ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Service Description

AIMeditateMe is a mobile application that uses artificial intelligence to generate personalized meditation sessions based on user input and mood. The Service includes audio meditation playback, mood tracking, journaling features, and user accounts.

The Service is intended to be used as a tool for personal wellness and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

You are responsible for your use of the Service and for any content you provide, including compliance with applicable laws, rules, and regulations.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. This may include your email address, name/username, and authentication credentials. If you use Apple Sign-In, we may receive your Apple ID information.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may request your account to be deleted at any time by contacting our support at support@aimeditateme.com. Upon receiving your request, we will process the account deletion.

3. Subscription and Payment

AIMeditateMe operates on a credit-based system with the following options:

  • Subscription model that grants a specific amount of credits on a recurring basis
  • One-time purchases for additional credits beyond what is included in your subscription

Credits are used within the app to generate and access personalized meditation content.

By subscribing to our service or making in-app purchases, you agree to pay the fees indicated. Payments are processed through the Apple App Store and are subject to Apple's terms and conditions.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription through your account settings in the App Store.

Refund Policy: All purchases are final and non-refundable.

Fee Changes

AIMeditateMe, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

4. Data Collection and Privacy

We collect and process various types of data to provide and improve our Service. The types of data we collect include:

  • Account information (email, name, authentication details)
  • Health and wellness data (mood tracking, meditation history, journal entries)
  • Technical data (device information, usage statistics, error logs)
  • Payment information (subscription status, purchase history, credit balance)

We use this data for:

  • Personalizing meditation content
  • Account management and authentication
  • Subscription and payment processing
  • App improvement and bug fixing
  • Push notifications for reminders (with your consent)

5. Third-Party Services

Our Service integrates with several third-party services to provide functionality. These may include:

  • Database and authentication providers
  • Payment processing services
  • Error tracking and analytics tools
  • Authentication services
  • Artificial intelligence services

Your data may be shared with these trusted partners as necessary to provide our Service. Your use of these third-party services through our app is subject to their respective terms of service and privacy policies. While we select partners who maintain high standards for security and privacy, we are not responsible for the practices of these third parties.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of AIMeditateMe and its licensors.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AIMeditateMe.

Content Ownership and Licensing

Once you submit, post, or share Content through the Service, you transfer all ownership rights of such Content to AIMeditateMe. You no longer retain any ownership rights to any Content you submit, post, or display on or through the Service.

By posting Content using the Service, you grant us an irrevocable, perpetual, worldwide, royalty-free, and fully sublicensable right and license to use, copy, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, and otherwise fully exploit such Content in any manner, media, or technology, whether now known or hereafter developed. This includes, without limitation, the right for us to make your Content available to other users of the Service, who may also use your Content.

AIMeditateMe has the right but not the obligation to monitor, edit, remove, or alter any Content provided by users at our sole discretion, for any reason or no reason, without notice.

7. User Content and Prohibited Uses

You agree not to use the Service for any prohibited purposes, including:

  • Violating any applicable laws or regulations
  • Impersonating any person or entity
  • Harassing, abusing, or harming another person
  • Uploading malicious code or attempting to interfere with the Service
  • Attempting to access areas of the Service you are not authorized to access
  • Using the Service for any illegal or unauthorized purpose

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable at our sole discretion.

Account Restrictions

When you create an account with us, you guarantee that you are above the age of 13, and if under 18, you have parental consent as specified earlier in these Terms. You also guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You may not use as a username the name of another person or entity, a name that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is offensive, vulgar, or obscene.

8. Data Retention and Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized or unlawful processing, accidental loss, destruction, or damage. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

9. International Data Transfers

Your information may be transferred to and processed in countries other than the country in which you reside. These countries may have data protection laws that are different from the laws of your country.

By using our Service, you consent to the transfer of your information to countries outside your country of residence, including the United States, where our primary servers are located.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall AIMeditateMe, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed, our liability will be limited to the maximum extent permitted by law.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

AIMeditateMe, its subsidiaries, affiliates, and its licensors do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

The Service is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

12. Dispute Resolution

CLASS ACTION WAIVER: Any proceedings to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

15. Communications

By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any or all of these communications from us by following the unsubscribe link or instructions in any email we send or by contacting us.

16. Indemnification

You agree to defend, indemnify and hold harmless AIMeditateMe and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Service, by you or any person using your account and password
  • A breach of these Terms
  • Content posted on the Service by you
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right

17. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

18. Entire Agreement

These Terms constitute the entire agreement between you and AIMeditateMe regarding our Service and supersede and replace any prior agreements we had between us regarding the Service.
